General Terms and Conditions of De Bonte Koe BV, located in Schiedam

1. General

1.1 These general terms and conditions apply to all offers made by De Bonte Koe BV. The conditions are accessible to everyone and are included on the website of De Bonte Koe BV. Upon request, we will send you a written copy.
1.2 By placing an order, you indicate that you agree with the delivery and payment terms. De Bonte Koe BV reserves the right to modify its delivery and/or payment terms after the expiry of their validity period.
1.3 Unless otherwise agreed in writing, general or specific terms or conditions from third parties are not recognized by De Bonte Koe BV.
1.4 De Bonte Koe BV guarantees that the delivered product complies with the agreement and meets the specifications stated in the offer.

2. Ordering Time

2.1 You can order from Monday to Friday until 16:00. In principle, you will receive the products the next day; however, we cannot provide a guarantee. Products for Monday delivery must be ordered by Friday 16:00.
2.2 Orders are always confirmed by email to the address you provided. Please check all details carefully. De Bonte Koe BV is not responsible for any typing errors.
2.3 De Bonte Koe BV is not responsible for incorrectly provided addresses.

3. Delivery

3.1 Delivery takes place as long as stock lasts.
3.2 In accordance with distance selling regulations, De Bonte Koe BV will execute orders within 30 days. If this is not possible (because the product is not in stock or no longer available), or if there is a delay for any other reason, or if an order can only be partially fulfilled, the consumer will be informed within 1 month of placing the order and has the right to cancel without cost.
3.3 We generally do not deliver on Sundays, public holidays, King’s Day, New Year’s Eve, and 24 December, unless otherwise agreed with you.
3.4 In the event of emergencies or natural disasters, we reserve the right not to deliver products.

4. Payment

4.1 For orders via the website, the buyer may only pay in advance using iDeal or credit card.
4.2 Products not paid for via iDeal or credit card will not be delivered.
4.3 Invoice orders must be paid within 14 days to IBAN NL66 INGB 0009 6792 38, stating the invoice number.

5. Prices

5.1 All prices on the site are in Euros and include 9% VAT.
5.2 Prices will not be increased during the validity period of the offer unless required by law or if the manufacturer implements interim price increases.
5.3 All prices on the site are subject to printing and typographical errors. No liability is accepted for the consequences of such errors.

8. Warranty

8.1 De Bonte Koe BV guarantees that the products it delivers meet the intended usability, reliability, and lifespan as reasonably intended by both parties.
8.2 De Bonte Koe BV is never responsible for the suitability of the goods for any individual application by the buyer, nor for any advice regarding their use.
8.3 The buyer must inspect the delivered goods immediately upon receipt. If the delivered item is incorrect, defective, or incomplete, the buyer must notify De Bonte Koe BV in writing immediately before returning it. Defects or incorrect deliveries must be reported in writing within 2 months. Returns must be sent in the original packaging (including accessories and documentation) and in new condition. Use after discovering a defect voids the right to complain or return.
8.4 If a complaint is found valid, De Bonte Koe BV will replace the item free of charge or make a written compensation arrangement. Liability is limited to the invoice amount or the maximum covered by the liability insurance. All other liability, including indirect or consequential damage, is excluded.
8.5 De Bonte Koe BV is not liable for damage caused by intent or gross negligence of non-management personnel.
8.6 Warranty does not apply if:
A) the buyer is in default;
B) the goods were exposed to abnormal conditions, treated carelessly, or used contrary to instructions.

9. Offers

9.1 Offers are non-binding, unless stated otherwise.
9.2 After acceptance of a non-binding offer, De Bonte Koe BV may withdraw it within 3 working days.
9.3 Oral commitments are only binding after written confirmation.
9.4 Offers do not automatically apply to repeat orders.
9.5 De Bonte Koe BV is not bound by an offer if the buyer should have understood it involved a mistake.
9.6 Additions or changes are only valid if agreed in writing.

10. Agreement

10.1 An agreement is established once De Bonte Koe BV has assessed the order for feasibility.
10.2 De Bonte Koe BV may refuse orders without providing reasons or may require prepayment or cash-on-delivery.

11. Images and Specifications

11.1 All images, photos, drawings, weights, dimensions, colors, and label depictions on the website are indicative only and cannot lead to compensation or cancellation.

12. Force Majeure

12.1 De Bonte Koe BV is not liable if obligations cannot be met due to force majeure.
12.2 Force majeure includes any external cause not reasonably attributable to De Bonte Koe BV, such as supplier failures, internet outages, electricity failures, transport issues, strikes, illness, and governmental measures.
12.3 De Bonte Koe BV may suspend obligations or dissolve the agreement in whole or in part in the event of force majeure. No compensation is owed.
12.4 If partial obligations are already fulfilled, De Bonte Koe BV may invoice the delivered portion separately.

13. Retention of Title

13.1 All delivered goods remain property of De Bonte Koe BV until all obligations have been met.
13.2 Goods under retention of title may only be resold in normal business operations.
13.3 Buyer may not pledge or encumber goods under retention of title.
13.4 Buyer grants De Bonte Koe BV permission to enter all locations where its property is held and retrieve these goods.
13.5 Buyer must inform De Bonte Koe BV immediately if third parties attempt to seize such goods.

14. Applicable Law / Competent Court

14.1 Dutch law applies to all agreements.
14.2 Disputes will be submitted to the court of Rotterdam unless De Bonte Koe BV chooses the buyer’s local court.

15. Gift Cards

15.1 Shop and webshop gift cards are valid for 2 years after issue. Cards purchased before 2022 are no longer valid. Workshop vouchers cannot be exchanged for shop/webshop gift cards.

16. Business Orders

16.1 Business orders must first be approved by De Bonte Koe, after which an invoice is issued.
16.2 The invoice must be paid within 14 days to IBAN NL66 INGB 0009 6792 38.
16.3 Address details used for shipping will be deleted afterward from both online and offline systems.

17. Weight

17.1 Products are handcrafted. Weight may vary up to 10% and does not entitle the buyer to discounts or compensation.

18. Webshop and Pickup

18.1 For in-store pickup, the customer will be notified when the order is ready. The order remains available for two weeks; uncollected orders expire without refund.
18.2 For deliveries to a pickup point, the customer is responsible for timely pickup. If the package is returned due to non-collection, the customer bears the costs. Reshipment is only possible after paying new shipping costs.
